1.1 Effective Date. The effective date of these Terms of Use is October 31, 2019.

1.2 Agreement. Welcome! Tri-State Waterproofing Inc. (“Tri-State Waterproofing” or “Company“) authorizes you to access and use this Tri-State Waterproofing website (the “Website“) on the condition that you agree to be bound by these terms (these “Terms of Use“) and to accept Tri-State Waterproofing’s separate Privacy Policy athttps://tristatewaterproofing.net/privacy-policy/ (the “Privacy Policy“). If you do not accept both these Terms of Use and the Privacy Policy, you may not access or use the Website, and you must immediately cease accessing or using the Website.

  1. Changes to Terms of Use and Privacy Policy.Internet technology and the applicable laws, rules, and regulations change frequently. Accordingly, Tri-State Waterproofing reserves the right to change these Terms of Use and the Privacy Policy at any time by the posting of a new version or a change notice to the Website. It is your responsibility to review these Terms of Use and the Privacy Policy periodically. If at any time you find either these Terms of Use or the Privacy Policy unacceptable, you must immediately cease accessing and/or using the Website. Unless Tri-State Waterproofing obtains your express consent, any revised Privacy Policy will apply only to information collected by Tri-State Waterproofing after the revised Privacy Policy takes effect, and not to information collected under any earlier versions of the Privacy Policy.

3.1 Age. This Website is not intended for use by anyone under 18 years old. If you are under the age of 18, you may use the Website only with permission of a parent or guardian.

3.2 Corporate Use. If you are using the Website on behalf of a company, you further represent and warrant that you are authorized to act and enter into contracts on behalf of that company.

Consent to Receive Electronic Communications from Company.By registering with the Website and providing your name, email, postal or residential address, and/or phone number through the Website, you expressly consent to receive email and other communications from Tri-State Waterproofing, both over the short term and periodically. These communications, among other things, may be about the Website, new product offers, promotions, and other matters. You may opt out of receiving electronic communications at any time by following the unsubscribe instructions contained in each communication, or by sending an email to info@computing-solutionsinc.com. You agree that these electronic communications satisfy any legal requirements that communications or notices to you be in writing.

Third Party Sites.The Website contains links to websites operated by third parties (“Third Party Sites”), some of which may have established relationships with Tri-State Waterproofing and some of which may not. Tri-State Waterproofing does not have control over the content and performance of Third Party Sites. Tri-State Waterproofing has not reviewed, and cannot review or control, the material, including computer software or other goods or services, made available on Third Party Sites, and Tri-State Waterproofing does not represent, warrant, or endorse any Third Party Sites, or the accuracy, currency, content, fitness, lawfulness, or quality of the information, material, goods, or services available through Third Party Sites. Tri-State Waterproofing disclaims, and you agree to assume, all responsibility and liability for any damages or other harm, whether to you or to third parties, resulting from your use of Third Party Sites.
  3. User Content.

6.1 User Content Defined. “User Content” is any content, material, or information, not including personally identifiable information (e.g., first and last name, address, phone number, email address, etc.), that you submit, upload, and/or post to, or transmit, display, perform, or distribute by means of the Website, whether in connection with your use of the Website or otherwise. This includes, without limitation, personal photos and videos.

6.2 You Own Your User Content. Tri-State Waterproofing does not claim ownership of any User Content. You retain all right, title, and interest, including without limitation all worldwide intellectual property rights, in and to your User Content.

6.3 License of User Content. By submitting, uploading, or posting User Content in any form with, through, or to the Website, you grant Tri-State Waterproofing a royalty-free, perpetual, non-exclusive, unrestricted, fully paid-up, worldwide, sublicensable license to copy or otherwise reproduce, modify, adapt, translate, distribute, enhance, transmit, publicly display or perform, reformat, and/or otherwise use User Content in connection with the operation of the Website, the business of Tri-State Waterproofing and its affiliates, or any other similar or related business, in any medium now existing or later devised, including without limitation in advertising and publicity. You further agree that the Tri-State Waterproofing may publish or otherwise disclose your personal information in connection with its exercise of the license granted under this section. You waive any claims arising from or relating to the exercise by Tri-State Waterproofing and its affiliates of the rights granted under this section, including without limitation any claims relating to your rights of personal privacy and publicity. You will not be compensated for any exercise of the license granted under this section.

6.4 Your Representations About User Content. You represent and warrant that you: (a) own all right, title, and interest in and to all User Content you submit, or are otherwise authorized to grant the rights provided the Tri-State Waterproofing and its affiliates under this section; or (b) have written consent, release, and/or permission of every identifiable individual person in any User Content you submit to use the name and likeness of every identifiable person in the User Content. You agree that you will not submit any User Content that does not fully comply with Tri-State Waterproofing’s prohibitions against Objectionable Content, as detailed in Section 7 (Objectionable Content; Defamation).

6.5 Company’s Right to Reject User Content. Tri-State Waterproofing reserves the right, in its sole discretion, to reject any User Content for any reason. The categories specified in Section 7 (Objectionable Content, Defamation) are not an exhaustive lists of content that Tri-State Waterproofing reserves the right to remove or deny.

  1. Objectionable Content, Defamation.

7.1 You may not use the Website to upload, post, transmit, display, perform, or distribute any content, information, or materials that: (a) are libelous, defamatory, abusive, threatening, excessively violent, harassing, obscene, lewd, lascivious, filthy, or pornographic; (b) constitute child pornography; (c) solicit personal information from or exploit in a sexual or violent manner anyone under the age of 18; (d) incite, encourage, or threaten physical harm against another; (e) promote or glorify racial intolerance, use hateful and/or racist terms, or signify hate toward any person or group of people; (f) glamorize the use of illegal substances and/or drugs; (g) advertise or otherwise solicit funds or constitute a solicitation for goods or services; (h) violate any provision of these Terms of Use or any other Tri-State Waterproofing agreement or policy, including without limitation Tri-State Waterproofing’s Privacy Policy; (i) disclose another’s personal, confidential, or proprietary information; (j) are false or fraudulent; (k) contains images or videos of individuals captured or posted without their consent; (l) promote self-destructive behavior (including without limitation eating disorders or suicide); or (m) are generally offensive, rude, mean-spirited, or in bad taste, as determined by Tri-State Waterproofing in its sole discretion (collectively, “Objectionable Content“). Tri-State Waterproofing disclaims any perceived, implied, or actual duty to monitor content made available through the Website, and specifically disclaims any responsibility or liability for information provided on the Website. Without limiting any of its other remedies, Tri-State Waterproofing reserves the right to terminate your use of the Website or your uploading, posting, transmission, display, performance, or distribution of Objectionable Content. Tri-State Waterproofing, in its sole discretion, may delete any Objectionable Content from its servers. Tri-State Waterproofing intends to cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms of Use or of any applicable laws.

7.2 Without limiting Section 7.1, you may be held legally responsible for damages suffered by other users or third parties as the result of your remarks, information, feedback, or other content posted or made available through the Website that are deemed defamatory or otherwise legally actionable. Under Section 230 of the Federal Communications Decency Act of 1996, Tri-State Waterproofing is not legally responsible, nor can it be held liable for damages of any kind, arising out of or in connection to any defamatory or otherwise legally actionable remarks, information, feedback, or other content posted or made available through the Website.

7.3 If you raise or file any claim against Tri-State Waterproofing for conduct that an arbitrator or court later finds to constitute an “exercise of a publisher’s traditional editorial functions,” or the legal equivalent thereof, you agree to fully and immediately compensate Tri-State Waterproofing for all losses, liability, damages, costs, and expenses, including without limitation all attorneys’ fees and expenses in defending the action and resolving the matter. If you fail to compensate Tri-State Waterproofing for any such claim, you hereby agree and authorize Tri-State Waterproofing to report your personal information, including without limitation your unpaid claim, to consumer credit reporting services, collection agencies, and others.

  1. Intellectual Property.

8.1 Compliance with Law.

8.1.1 General. When using the Website, you will obey all applicable laws and respect the intellectual property rights of others. Your use of the Website is at all times subject to limitations imposed by copyright and other intellectual property laws. You must not upload, post, transmit, display, perform, or distribute any content, information, or other materials in violation of any third party’s copyrights, trademarks, or other intellectual property or proprietary rights.

8.1.2 User Content. You are and will be solely responsible for any violations of any laws and for any infringements of third party rights caused by your use of the Website. Tri-State Waterproofing users bear the sole burden of proving that content, information, or other materials do not violate any laws or third party rights.

8.2 Trademarks. Tri-State Waterproofing and the Tri-State Waterproofing logo (collectively, the “Company Marks“) are trademarks or registered trademarks of Tri-State Waterproofing. Other trademarks, service marks, graphics, logos, and domain names appearing anywhere on, through, or in connection with the Website may be the trademarks of third parties. Neither your use of the Website nor these Terms of Use grant you any right, title, or interest in, or any license to reproduce or otherwise use, the Company Marks or any third party trademarks, service marks, graphics, logos, or domain names. You agree that any goodwill in the Company Marks generated as a result of your use of the Website will inure to the benefit of Tri-State Waterproofing, and you agree to assign, and hereby do assign, all such goodwill to Tri-State Waterproofing. You shall not at any time, nor shall you assist others to, challenge Tri-State Waterproofing’s right, title, or interest in, or the validity of, the Company Marks.

8.3 Copyrighted Materials; Copyright Notice. All content and other materials available through the Website, including without limitation the Tri-State Waterproofing logo, design, text, graphics, and other files, and the selection, arrangement, and organization thereof, are either owned by Tri-State Waterproofing or are the property of Tri-State Waterproofing’s licensors and suppliers. Except as explicitly provided, neither your use of the Website nor these Terms of Use grant you any right, title, or interest in any such materials.

8.4 DMCA Policy.

8.4.1 As Tri-State Waterproofing asks others to respect Tri-State Waterproofing’s intellectual property rights, Tri-State Waterproofing respects the intellectual property rights of others. Tri-State Waterproofing follows the notice and takedown procedures in the Digital Millennium Copyright Act (“DMCA“).

8.4.2 If you believe content located on or linked to by the Website violates your copyright, please immediately notify Tri-State Waterproofing by means of emailed DMCA takedown notice (“Infringement Notice“), providing the information described below. 8.4.6 Tri-State Waterproofing will respond to all DMCA-compliant Infringement Notices, including, as required or appropriate, by removing the offending material or disabling all links to the offending material.

8.4.7 Disclosure. All received Infringement Notices may be posted in full to the Lumen database (https://lumendatabase.org/), previously known as the Chilling Effects Clearinghouse.

  1. Disclaimers; Limitation of Liability.

9.1 No Warranties. Tri-State Waterproofing, on behalf of itself and its licensors and suppliers, hereby expressly disclaims any and all warranties, express or implied, regarding the Website, arising by operation of law or otherwise, including without limitation any and all implied warranties of merchantability, fitness for a particular purpose, non-infringement, no encumbrance, or title, in addition to any warranties arising from a course of dealing, usage, or trade practice. Neither Tri-State Waterproofing nor its licensors or suppliers warrants that the Website will meet your requirements, or that the operation of the Website will be uninterrupted or error-free. Tri-State Waterproofing disclaims all implied liability for damages arising out of the furnishing of the Website pursuant to these Terms of Use, including without limitation, mistakes, omissions, interruptions, delays, tortious conduct, errors, representations, or other defects arising out of the failure to furnish the Website, whether caused by acts of commission or omission, or any other damage occurring. 9.2 Limitation of Liability. In no event shall Tri-State Waterproofing or its licensors or suppliers be liable to you for any claims arising from your use with the Website, including without limitation for special, incidental, or consequential damages, lost profits, lost data or confidential or other information, loss of privacy, costs of procurement of substitute goods or services, failure to meet any duty including without limitation of good faith or of reasonable care, negligence, or otherwise, regardless of the foreseeability of those damages or of any advice or notice given to Tri-State Waterproofing or its licensors and suppliers arising out of or in connection with your use of the Website. This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action.   1. Indemnity by You.

10.1 Without limiting any indemnification provision of these Terms of Use, you (the “Indemnitor“) agree to defend, indemnify, and hold harmless Tri-State Waterproofing, its affiliates and their respective officers, directors, employees and representatives (collectively, the “Indemnitees“) from and against any and all claims, actions, demands, causes of action, and other proceedings (individually, “Claim“, and collectively, “Claims“), including but not limited to legal costs and fees, and providing sole and exclusive control of the defense of any action to Tri-State Waterproofing, including the choice of legal counsel and all related settlement negotiations, arising out of or relating to: (i) the relationship between you and Tri-State Waterproofing, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory; (ii) your breach of these Terms of Use, including without limitation any representation or warranty contained in these Terms of Use; (iii) your access to or use of the Website; (iv) your provision to Tri-State Waterproofing or any of the Indemnitees of information or other data; (v) your violation or alleged violation of any foreign or domestic, international, federal, state, or local law or regulation; or (vi) your violation or alleged violation of any third party’s copyrights, trademarks, or other intellectual property or proprietary rights.

10.2 The Indemnitees each have the individual right, but not the obligation, to participate through counsel of their choice in any defense by you of any Claim as to which you are required to defend, indemnify, or hold harmless any, each, and/or all Indemnitees. You may not settle any Claim without the prior written consent of Tri-State Waterproofing.

10.3 Without limitation, the Indemnitor also hereby agrees to compensate Tri-State Waterproofing for any and all lost revenues, future lost profits, reasonable search costs, and any other reasonable expenses resulting from any Indemnitor violation of Section 7 (Objectionable Content, Defamation), including without limitation any suspension of affiliate accounts or affiliate payment attributable to fraudulent efforts to manipulate or otherwise modify reported impressions generated by the Tri-State Waterproofing or its affiliates under any affiliate advertising agreement.

  1. Notices.All notices required or permitted to be given under these Terms of Use must be in writing.

11.1 Tri-State Waterproofing shall give any notice by email sent to the most recent email address, if any, provided by the intended recipient to Tri-State Waterproofing or by posting the notice to the Website. You agree that any notice received from Tri-State Waterproofing electronically or posted to the Website satisfies any legal requirement that such notice be in writing.

11.2 You bear the sole responsibility of ensuring that your email address on file with Tri-State Waterproofing is accurate and current, and notice to you shall be deemed effective upon the sending by Tri-State Waterproofing of an email to that address.

11.3 You shall give any notice to Tri-State Waterproofing by means of email to info@computing-solutionsinc.com.

12.1 Entire Agreement. These Terms of Use constitutes the entire agreement between Tri-State Waterproofing and you concerning your use of the Website.

12.2 Partial Invalidity. Should any part of these Terms of Use be declared invalid, void, or unenforceable by a Court of Competent Jurisdiction, such decision shall not affect the validity of any remaining portion hereof, which shall remain in full force and effect, and the parties hereby acknowledge and agree that they would have executed the remaining portion hereof without including the part so declared by a Court of Competent Jurisdiction to be invalid, void, or unenforceable.

12.3 Amendments. Tri-State Waterproofing may change these Terms of Use from time to time by posting the amended Terms of Use on the Website.

12.4 No Waiver. A waiver by either party of any term or condition of these Terms of Use, or any breach, in any one instance, will not waive that term or condition or any later breach.

12.5 Assignment. These Terms of Use and all of your rights and obligations under it will not be assignable or transferable by you without the prior written consent of Tri-State Waterproofing. These Terms of Use will be binding upon and will inure to the benefit of the parties, their successors, and permitted assigns.

12.6 Governing Law; Arbitration. These Terms of Use are governed by laws of Georgia, without regard to the choice or conflicts of law provisions of any jurisdiction. Any dispute, claim, or controversy arising out of or relating to these Terms of Use or the enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this Section 12.6, will be determined by arbitration in Lula, Georgia before one arbitrator. The arbitration will be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction. This Section 12.6 will not preclude Tri-State Waterproofing from seeking provisional remedies in aid of arbitration or from protecting or enforcing Tri-State Waterproofing’s intellectual property rights, in either case from any federal or state court that has jurisdiction over the subject matter and is located in the state of Georgia.

12.7 Injunctive Relief. You acknowledge and agree that any actual or threatened breach of these Terms of Use or infringement of proprietary or other third party rights by you would cause irreparable injury to Tri-State Waterproofing and Tri-State Waterproofing’s licensors and suppliers, and would therefore entitle Tri-State Waterproofing or Tri-State Waterproofing’s licensors or suppliers, as the case may be, to injunctive relief.

12.8 Headings. The headings in these Terms of Use are for convenience only, and shall have no legal or contractual effect.

    Tri-State Waterproofing Service
    Tri-State Waterproofing Service provides a suite of marketing automation services related to various forms of marketing and customer interaction, email marketing, storage capabilities, and lead analytics that relies on proprietary tools, technology and know-how (collectively, “Service”). The Service is provided to businesses or agencies (“Customers”) pursuant to services agreement and subject to the payment of a fee for such Service. The Service is provided through a restricted area accessible to Customers only, from the www.tristatewaterproofing.net, app.tristatewaterproofing.net, or *.marketingautomation.services websites.
    Tri-State Waterproofing Service Platform
    In connection with the promotion of the Tri-State Waterproofing Service, Tri-State Waterproofing Service has developed and operates the Tri-State Waterproofing Service website, specialized content, reports, software applications, social media pages, and uses other means of interacting with individuals about the Tri-State Waterproofing Service, such as emails, newsletters, or phone calls, marketing events and participation at trade shows. All such methods of promotion and sale of the Tri-State Waterproofing are designated as the “Platform”.

    Customer Representative Data
    When a Customer has purchased the Service, we create an account on our Platform, in the name of the Customer. The Customer has the ability to create one or several accounts. For each authorized Customer Representative allowed to use these accounts, we request:

  • Only the minimum amount of information necessary to operate or manage the account is mandatory. The Customer Representative may elect to provide additional information, which we may use to enhance the Service, for example by offering access to social media accounts through the Service.
    To access the Customer account, the registrant is required to choose a password.
    Information the User Makes Public
    The Platform contains features that allow certain users to upload, post, transmit, display, perform, or distribute content, or other information, including their Personal data. Any information that the user chooses to disclose by means of such features may become public information.
    Tri-State Waterproofing Service is unable to exercise control over this information once the user has made it public. You should exercise caution when deciding to disclose your Personal data by means of such features, and you are solely responsible for any uses or misuse of such information.
    Publicly Available Information
    We supplement information that we receive directly from the user or the user’s equipment with additional information that is available from public sources, in public records, or other publicly available databases or from information that the user has made public, for example, in tweets or Facebook posts.
    Payment Information
    When a Customer pays for the Service, we collect the method of payment, date and amount of the payment. If the Customer pays with a credit card, this information is transmitted directly to our payment processor, and we do not retain the details of the payment information other than the Transaction ID number. After payment card information is entered, we do not have access to payment card information and disclaim any liability for any loss or compromise of payment card information. When you make a payment, you agree to terms of our payment processor.
    In the case of an ongoing relationship, we retain information about the Customer’s payment history as necessary for the administration of the Customer account.
    Communication from Users
    When a visitor or lead completes an online form, visits our website or other areas of our Platform (for example on social media), or when a user otherwise contacts us, by email, phone or text, we automatically collect and store certain information about that user and the user’s activities, as we receive from such user, for example:
    • The user’s name and contact information.
    • Information that the user provides to us.
    • The user’s company information, if any.
    • The nature of the communication.
    • The purpose of the interaction, and the action we took in response to the user’s inquiry or request.

    Surveys and Contests
    From time-to-time, we invite users to participate in surveys or contests. Participation is voluntary. These surveys are organized for the purposes of our marketing efforts.
    When a user participates, we request certain personal data such as name and email address. This is necessary to ensure that responses are categorized properly and are not duplicated
    Depending on the nature of the survey or contents, we also use this information to send the survey results to the participants, or, if applicable, to notify contest winners and award prizes.

    Information we Obtain from Third Parties
    We receive information from third party data providers including directories. In some cases, such as LinkedIn, the information has manifestly been made public by the individuals who posted their profile on LinkedIn, and we assume that the individuals no longer have a privacy interest in such information, and it can be used for the legitimate interest of Tri-State Waterproofing Service in learning about potential Customers.
    Email Accounts
    Users may opt-in to use features of the Platform which regularly collect and store the contents of emails from their email accounts, which are hosted by third-party email service providers. This is done for the purpose of providing advanced features of the Platform and is only done at the user’s express direction.
    In order to provide these features, the Platform must authenticate with the user’s third-party email accounts. When possible, this is done using OAuth.
    For example, the Platform will use OAuth to securely authenticate with a user’s particular email account. Once authenticated, the OAuth authentication, or “bearer” token, is encrypted and stored, and is used on subsequent requests to prove authentication. When OAuth is not possible, we encrypt and store the user’s third-party email account credentials, and thereafter use them to securely authenticate with the third-party email service.
    Access to email account authentication tokens and credentials (where applicable), the keys to decrypt this data, and user email content, is limited to only employees who need access to support and develop the Platform and only within the scope of their job responsibilities. The user’s authentication tokens or credentials, and email data, is never shared with third-parties.
    For users who authorize and use OAuth with their Gmail account through Google, the use of data obtained through the Platform will comply with Google’s additional Restricted Scopes requirements that are listed in the Google API Services: User Data Policy.     Customers who have a registered account may also opt out of receiving commercial electronic communications by logging in to their Tri-State Waterproofing Service account, clicking on “Settings,” “User Accounts,” selecting a user, then editing the options in “Notification Options.” We will comply with your request(s) within ten (10) working days.
    Please also note that if you do opt out of receiving commercial electronic communications from us, we may still send you important administrative messages (such as updates about your account or service changes), and you cannot opt out from receiving these messages.

    Accessing, Correcting or Deleting Your Information
    Registered Users who have an account with Tri-State Waterproofing Service have the right to review, change, or suppress personal data that we have collected from them. There are several ways to do this.
    You can update your account information and your profile settings by logging into your account.
    You can also contact us as indicated in the “How to Contact Us” section.
    We may need to retain certain information for mandatory record keeping purposes and/or to complete any transactions that you began prior to your request. Residual information may remain within our databases and other records, but it will no longer be tied to your identity.
    We want each Registered User’s Information to be complete and accurate. To confirm the completeness and accuracy of, or make changes to, their Personal data, Registered Users are encouraged to visit their personal profile.
  • EU/EEA Residents: Data Subject Rights under the GDPR.
    The EU General Data Protection Regulation (GDPR) grants individuals who are in the United Kingdom, the European Union and European Economic Area (EU/EEA) the following rights, with some limitations. Users may contact us, at the address provided in the “How to Contact us” section below, to exercise any of those rights and we will respond with the requested action or information, or will let you know why that right does not apply to you.
    Right Not to Provide Consent or to Withdraw Consent
    We may seek to rely on your consent in order to process certain personal data. Where we do so, you have the right not to provide your consent, and the right to withdraw your consent at any time.   • California Residents: Rights under California Law.
    California requires operators of websites or similar services to make certain disclosures to users who reside in California regarding their rights, specifically:

    Under California law, a business that has an established business relationship with an individual, and has, within the immediately preceding calendar year, disclosed personal data that is primarily used for personal, family or household purposes to third party for the third party’s direct marketing purposes, must disclose to its California users, upon request, the identity of any such third party, along with the type of personal data disclosed.

    Do-Not-Track
    Some browsers give individuals the ability to communicate that they wish not to be tracked while browsing on the Internet. California law requires that we disclose to users how we treat do-not-track requests. The Internet industry has not yet agreed on a definition of what “Do Not Track” means, how compliance with “Do Not Track” would be measured or evaluated, or a common approach to responding to a “Do Not Track” signal. Due to the lack of guidance, we have not yet developed features that would recognize or respond to browser-initiated Do Not Track signals in response to California law.
    In the meantime, there are technical means to prevent some of the tracking, if any. See Section “Your Advertising Choices.”
  • Children’s Privacy.
    Our Platform is not directed to individuals under the age of 18. We do not solicit or knowingly collect Personal data from such individuals. If you become aware that a child has provided us with personal data, please contact us as indicated in the “How to Contact Us” section below. If we obtain actual knowledge that we have collected Personal data from a child under the age of 18, we will take steps to delete such information from our database.

    • Sufficient information to allow us to locate the content or information to be deleted, removed or corrected

    In addition, please note that, depending on the nature of your inquiry, request or complaint, we may need to verify your identity before implementing your request and may require proof of identity, such as in the form of a government issued ID and proof of geographical address.
    We will try to comply with your request as soon as reasonably practicable. However, we reserve the right to refuse to act on a request that is manifestly unfounded or excessive (for example because it is repetitive) and/or, in some cases, to charge a fee that takes into account the administrative costs for providing the information or the communication or taking the action requested.
